THE RESPONSIBILITY AND INTENTION AND THEIR IMPACT ON PREVENTING THE PUNISHMENT

Abstract Praise be to Allah, the Lord of the Worlds, the Creator of the universe and creator of all creation, and I pray and greet the Prophet, the Truthful Promise, the Trustworthy, after that Abstract Praise be to Allah, the Lord of the Worlds, the Creator of the universe and creator of all creation, and I pray and greet the Prophet, the Truthful Promise, the Trustworthy, after that : The first section: the responsibility and intention and their impact in the prevention of punishment, and it has four requirements:First requirement: responsibility and good will, and the second requirement: it stated the good will standard in crimes with the definition of the standard with clarifying the sections of three crimes in Islamic law, and the standard of good will in these crimes, with mentioned examples, the third requirement: the researcher talked about the impact of good will in the penalties, and the doctrines of jurists and their evidence, right down to the chosen opinion; Islamic Sharia decides the principle of criminal liability on the basis of personal freedom and choice, so that it is in charge accountable to God and to the community on irregularities committed, and that responsibility specifies as much choice and the will of this criminal offense, as that of the good will and the ugly will has an impact in determining the criminal responsibility; then proceeded in a clarifying the fact of responsibility, and concluded for the chosen definition of responsibility and explaining this definition a detailed explanation, to be defined as an additional compound, the Fourth requirement: it reported the images of good and ugly will in some crimes and its provisions, as the doctor sometimes is the main reason in the destruction of the patient and the destruction of one of its members; and showing the sayings of scientists with details in all of this, and reaching to the correct opinion.
