THE RELIGIOUS RULING ON THE MARRIAGE OF AIDS-INFECTED INDIVIDUALS: A LEGITIMATE STUDY FROM ISLAMIC PURPOSES PERSPECTIVES


Abstract 

This research aims to examine the affair of marriage between AIDS (Acquired Immune-Deficiency Syndrome) infected individuals marriages from a purpose-based point of view in the Islamic jurisprudence. The problem of the research stems from the worldwide proliferation of this disease, and the common perception of it as a terminal condition, where the infected individual is believed to be unable to perform his\her routine daily activities. This research adopts the Analytic Descriptive Approach to examine the nature of this disease, and analyze the religious rulings and verdicts concerning it from the perspective of the purposes and objectives of the Islamic jurisprudence. This research endorsed the approval of such marriages, whether they take place between two AIDS-infected individuals or with one person who isn't infected, taking into account a number of restrictions controlling this process. This position is based on the recent medical approach to this condition.
