THE LEGITIMATE PURPOSES AND THEIR IMPACT ON THE DEVELOPMENT OF THE FATWA IN THE PROVISIONS OF MIQAT JEDDAH

This study comes in response to the requirements of reality as a basis of the important foundations in adapting the fatwas of the contemporary legitimacy of the position of Jeddah and how the legitimate objectives have an impact on the choice of fatwas. The purpose of this study is to define the fatwa and the legitimate objectives and to clarify the importance of linking between the legitimate objectives and the development of fatwa. The study aims to explain the ruling on IHRAAM from Jeddah and study the statements of the advanced jurists and the later ones, and the correct opinion, and the reasons for weighting according to the legitimate objectives. The study follows the analytical descriptive approach to analyze the data and concludes that the purpose of determining the provision is to protect the mufti from confusion, to understand the texts and to be able to bring down the rule. The discovery of the legitimate objectives in the position of Jeddah, which is the maximization of the rituals of God and humiliation and subjugation and facilitation and lift the embarrassment and hardship and bring interest and benefit and follow the Messenger of Allah peace be upon him, considered fatwas which are based on the recognized purposes and follow the rejected. |
